Making a Purchase

When placing an order online with Flue Pipe UK Limited (www.fluepipeuk.co.uk), you are entering into a legally binding contract valid under UK law.

We have tried to make it easy for anyone to purchase our products on-line. Browse through our products, click on the Add to Basket button to add any items you wish to purchase into your shopping cart. When you have selected all the items you require, click on the Checkout button. You will then be asked to complete your delivery details, shipping method and payment details, all required to complete your order.


1.    Orders

(a)    Official orders are only accepted through www.fluepipeuk.co.uk when the shopping cart is confirmed and payment made electronically via PayPal. This process is required for the supply of any goods.
(b)    Once orders have been placed as paragraph 1 (a) the customer is subject to the terms and conditions of sale with Flue Pipe UK Limited (www.fluepipeuk.co.uk)
(c)    Stenographical or clerical errors or omissions are subject to correction by Flue Pipe UK Limited (www.fluepipeuk.co.uk) at any time.
2.    Descriptions
(a) The description of the Goods shall be as set out Flue Pipe UK Limited Website and Virtual Shopping Cart (www.fluepipeuk.co.uk) along with the delivery note.
(b) All drawings, descriptive matter, specifications and advertising on the Website (www.fluepipeuk.co.uk) or issued by Flue Pipe UK Limited [or the manufacturer of the Goods] and any descriptions or illustrations contained in Flue Pipe UK Limited [or manufacturer's] catalogues or brochures are issued or published for the sole purpose of giving an approximate idea of the Goods described in them.  They do not form part of the Contract.


3.    Payment

Payment is required as paragraph 1 (a) all major credit cards are accepted along with PayPal. Flue Pipe UK Limited (www.fluepipeuk.co.uk) is PayPal certified to collect online payments and all financial transactions are covered by the PayPal guarantee and PayPal terms and conditions. Financial Information is encrypted and utilised by PayPal as per its terms and conditions

4.    Credit Card Security

Flue Pipe UK Limited (www.fluepipeuk.co.uk) and PayPal use the latest, industry-standard Secure Sockets Layer (SSL) technology to provide encryption of personal information such as your name, address and credit card details. In this way, information passed between your computer and Flue Pipe UK Limited (www.fluepipeuk.co.uk) cannot be read in the unlikely event of someone intercepting it. Credit or Debit card transactions are fully secure. The yellow padlock icon in your browser window confirms when you are viewing a secure area of a site.

 
5.    Cancellation

After acceptance in accordance with paragraph 1(a) above orders may only be cancelled or goods returned with the previous written consent of Flue Pipe UK Limited (www.fluepipeuk.co.uk) via the enquiry web page on the Website.  In the event of such cancellation being accepted Flue Pipe UK Limited (www.fluepipeuk.co.uk) shall be entitled to make such reasonable and proper cancellation charge upon such terms as to payment as shall compensate the Flue Pipe UK Limited (www.fluepipeuk.co.uk) for any loss or expense and costs incurred or to be incurred by it. If goods (Flue Pipe and Flue Pipe Accessories) are not required then they must be returned using Interlink at the consumers own cost and there is a 20% of order value restocking charge for all returned goods. All returned goods have to be in a resalable condition for this process to take place.
Exceptions to this are Flue Pipe options that are made to order, specifically all Flue Pipe over 8inch (200mm) in all ranges along with all accessories over 8inch (200mm) in all ranges. In addition to this all Anti-down draught cowls in all sizes are made to order bespoke for the customer. In this instance the sale of these items is such that they are “specials” and manufactured to order and thus un-returnable. The buyer when purchasing these items enters into the contract having full knowledge of this clause.

Your right to cancel

(a) Under the Consumer Protection (Distance Selling) Regulations 2000 (as amended), if you are a Consumer, you have the right to cancel the Contract for the purchase of the Goods and Services within 7 working days of the date upon which you agree to be bound under the Contract.  A working day is any day other than weekends and bank or other public holidays.
(b) Unless we agree otherwise with you in writing, you will not be able to cancel the Contract of sale and delivery under this clause once the performance of the Delivery Service has begun by Flue Pipe UK Limited.  Further, if you agree to our performance of the Services before the expiry of the 7 working day period noted in clause (a), above, you will not be able to cancel the Contract under this clause.
If, subject to clause (b), you exercise the right of cancellation set out in this clause (a), you should notify us via the enquiry web page on the Website (www.fluepipeuk.co.uk).


6.    Delivery/Returns for Flue Pipe Products

(a)    Delivery to the customer’s (Buyer’s) nominated address will be arranged subject to reasonable delivery and transportation charges being met by the customer. Flue Pipe UK Limited (www.fluepipeuk.co.uk) uses Interlink exclusively for all carriage of (Flue Pipe Products “Goods”) to and from our Manufacturing Supplier. Flue Pipe UK Limited (www.fluepipeuk.co.uk) has a minimum carriage charge of £12.00
(b)    All weights quoted for goods are approximate and cover packaging and volume of products for delivery along with multiple packaging.
(c)    Items ordered on any given day are processed the following day and should be shipped from the supplier for delivery in 2-3 working days.
(d)    Flue Pipe UK Limited (www.fluepipeuk.co.uk) will use its best endeavour to secure delivery on the estimated date but time and delivery is not of the essence of the contract and late delivery shall not give rise to any claim for diminution or price or damages.  The company will not be liable for delay or non-delivery due to industrial disputes or other causes beyond its control.
(e)    Flue Pipe UK Limited (www.fluepipeuk.co.uk) may rescind the contract if the manufacturer ceases to make goods of the type agreed to be sold whether the estimated date of delivery has arrived or not.  In this event the Flue Pipe UK Limited (www.fluepipeuk.co.uk) will refund to the customer any sums paid.
(f)    If goods are not required then they must be returned using Interlink at the consumers own cost and there is a 20% of order value restocking charge for all returned goods. All returned goods have to be in a resalable condition for this process to take place.
(g)    Refunds are given on the above conditions and costs are deducted accordingly.
(h)    All shipping issues will be dealt with via the enquiry web page on the Website (www.fluepipeuk.co.uk)
(i) Important Note: Risk of damage to or loss of Goods shall pass to the Buyer upon delivery.


6.1.    Delivery/Returns for Stove Products

(a)    Delivery to the customer’s (Buyer’s) nominated address will be arranged subject to reasonable delivery and transportation charges being met by the customer. For Standard UK Mainland Delivery the costs are incorporated in the “Stove” Price. Non Standard Delivery will result in an additional charge and the Buyer will be contacted to confirm these additional costs.
(b) Any dates specified by Flue Pipe UK Limited for delivery of the Goods are approximate only and may not be made of the essence by notice.  If no dates are so specified, delivery will be within a reasonable time.
(c) Standard Delivery is 2-3 Days from supplier (Champion Stoves) and is strictly doorstep only as stoves are in excess of 80KGs. Buyer’s will be contacted with an allotted day for delivery so that they can ensure they are present to take delivery on the allotted day as they need to unpack and check for defects especially the glass in door prior to signing for goods. Any damage not reported at delivery shall not be the responsibility of Flue Pipe UK Limited, Champion Stoves or the courier service used.
(d) Subject to the other provisions of these terms and conditions Flue Pipe UK Limited will not be liable for any loss (including loss of profit), costs, damages, charges or expenses caused directly or indirectly by  any delay in the delivery of the Goods
(e) If the Buyer fails to take delivery of any of the Goods, the Goods will be deemed to have been delivered and (without prejudice to its other rights) Flue Pipe UK Limited may:
(f) Store or arrange for the storage of the Goods until actual delivery or sale and charge the Buyer for all related costs and expenses (including, without limitation, storage and insurance); and/or
(g) Following written notice to the Buyer, sell any of the Goods at the best price reasonably obtainable in the circumstances and charge the Buyer for any shortfall below the price under the Contract.
(h)    All shipping issues will be dealt with via the enquiry web page on the Website (www.fluepipeuk.co.uk)
(i) Important Note: Risk of damage to or loss of Goods shall pass to the Buyer upon delivery.


7.    Loss or Damage in Transit

Flue Pipe UK Limited (www.fluepipeuk.co.uk) accepts no responsibility for loss or damage in transit.  Flue Pipe UK Limited (www.fluepipeuk.co.uk) will however give all reasonable assistance to the customer at the customer’s expense in any claim made against the carrier.

8.    Manufacturer Guarantee Flue Pipe Products

Subject as hereinafter provided the Manufacturer shall repair (or at its sole option replace) at its own cost all parts of its own manufacture which are or become faulty by reason only of the use of defective materials or by reason of defective workmanship within a period of 12 calendar months from the day when the goods shall become available for delivery to the customer subject to the following:-

(a)    The customer must give the company immediate written notice of any such defects and must not in anyway attempt to repair or remedy the defective goods.
(b)    The Company must be satisfied on inspection that the goods have not been put to abnormal or improper use: and
(c)    Any defective goods or parts must be returned carriage paid for inspection to the Manufacturer’s warehouse.  Goods and parts repaired or replaced under guarantee will be delivered to customers in the United Kingdom free of charge.
(d)    All additional Warranty and Guarantee schemes have specialist terms and conditions on a product and manufacturer basis. Full information is supplied with each product and independent registration by the customer with the manufacturer is required within 28 days of installation.

8.1.    Manufacturer Guarantee Stove Products

QUALITY: Flue Pipe UK Limited will endeavour to transfer to the Buyer the benefit of any warranty or guarantee given to Flue Pipe UK Limited.
(a) Champion Stoves warrants that (subject to the other provisions of these terms and conditions) upon delivery the Goods will, and for a period of 12 months from the date of delivery, be of satisfactory quality within the meaning of the Sale of Goods Act 1994.
(b) If the Buyer makes a valid claim against Champion Stoves based on a defect in the quality of the Goods, Champion Stoves shall at its option repair or replace such Goods (or the defective part) or refund the price of such Goods.
(c) If Champion Stoves complies with clause (b) it shall have no further liability for a breach of the warranty in clause (a) in respect of the quality such Goods.
(d) Any Goods replaced will belong to Champion Stoves and any repaired or replacement Goods will be guaranteed on these terms and conditions for the unexpired portion of the 12 month period.


9.    Exclusions

Flue Pipe UK Limited (www.fluepipeuk.co.uk) and the relevant manufacturers shall not be liable for any indirect damage caused to the customer or any others due to such faults and defects specified in condition 6, 6.1 above.

The Manufacturer’s liability under the above guarantee is limited to the cost or repairing or replacing any defective goods or parts and such liability shall terminate after the expiration of 12 months from the date of delivery.
